Terms of service

What you and we each agree to when you use PathClue to measure websites, apps and mini programs.

Last updated

The short version: you can use PathClue on any website, app or mini program that you own or are authorised to run. The Free plan has no end date. The data you collect is yours, and we process it only to run the service. Data is kept according to your plan (6 months on Free, 12 months on Pro, 24 months on VIP 1, 24 months on VIP 2); you can export or delete it whenever you like, and stop using PathClue at any time.

This isn’t legal advice. If the law where you live protects you more than these terms do, that law applies. We publish English and Chinese versions for convenience; if they differ, the English version applies unless mandatory local law says otherwise.

1. What these terms cover

PathClue is an analytics product run by TapCub (“we”, “us” in these terms). These terms apply to everything you do with PathClue (the “Service”): this website, the console you reach from this website’s sign-in link, the analytics script on static.pathclue.com, the SDKs for each platform, the collection endpoints, the server APIs and the help documentation. Creating an account, installing the script or an SDK, or clicking “I agree” means you accept these terms. If you accept for a company, you confirm that you can commit the company to them.

A few terms used below:

  • Account: the account you sign up and sign in with, together with every member you invite.
  • Site: each website, app or mini program you register in the console. Every Site has its own site key.
  • Visitor: a person who uses one of your Sites.
  • Visitor Data: data collected from Visitors. Account Data: data about you and your members.

Live chat is a separate product, AskCub, with its own subscription. If you are an enterprise customer with a signed agreement and it conflicts with these terms, the agreement applies.

2. Who can sign up, and who is responsible for the account

You must be 16 or older — or older still if your jurisdiction sets a higher age of digital consent — and give truthful details when signing up. Extra accounts opened to get around plan quotas or to collect rewards may be removed, along with whatever they produced.

What happens in your Account is your responsibility. Keep your password safe, turn on multi-factor authentication and remove members who no longer need access. If you think your Account may have been compromised, write to hello@tapcub.com straight away. Members act on your behalf; roles can limit what they see, but how they use the Service remains your responsibility.

3. What you must not do

Only add Sites that you own or that you are authorised to run. When using the Service, you agree not to:

  • collect sensitive personal data from Visitors without a lawful basis — health information, financial account details, identity document numbers or precise location, for example;
  • fake traffic or events to obtain quota, rewards or free upgrades;
  • probe, stress-test, scrape or attack the Service, or try to get around rate limits and bot filtering;
  • resell the Service beyond what your plan permits, or use it to build a product that competes with it;
  • upload malware, unlawful content or content that infringes someone else’s rights.

We may suspend a Site or Account that breaks these rules. Where it is practical and safe, we will tell you first and give you a chance to put it right.

4. Subscriptions and payment

PathClue offers four plans: Free, Pro, VIP 1 and VIP 2. Each plan’s limits — Sites, monthly events, retention, members and so on — are those shown on the pricing page when you buy. Prices are shown in US dollars, and paying yearly costs less than twelve monthly payments.

You can pay by card (processed by Stripe), PayPal, Alipay or WeChat Pay. These providers process the payment; we never store your card number. Where your payment method supports automatic renewal, your subscription renews at the end of each period; where it doesn’t, we remind you before your plan ends. Tax may be added where the law requires it.

Upgrades apply immediately, and you pay the difference for the rest of the current period. Downgrades apply from the next billing date. If a payment fails we try again and let you know; if it keeps failing, the plan ends as described in section 6.

Refunds: within 7 days of first starting a paid plan, you can ask for a full refund as long as the Account hasn’t used anything beyond the Free plan in that time. After 7 days, payments aren’t refundable unless consumer law where you live says otherwise.

5. The Free plan

The Free plan is a plan in its own right, not a trial: 500K events a month, no end date and no payment method needed. We may change its limits, and we will announce any change at least 30 days before it applies.

The console may offer ways to earn paid time without paying; the rules shown there apply. Earned time can only be used by your Account, and rewards obtained through fake traffic, fake referrals or multiple accounts don’t count.

6. Quotas, retention and the end of a plan

Quotas: once a month’s event quota is used up, later events that month are dropped and can’t be recovered. The count starts again on the 1st. Your Site itself is unaffected — the script and SDKs simply stop sending without any visible error.

Retention: analytics data is kept according to your plan: 6 months on Free, 12 months on Pro, 24 months on VIP 1, 24 months on VIP 2. Anything older is deleted automatically, and you can set a shorter period for any Site whenever you like.

End of a plan: if a paid plan ends and isn’t renewed, the Account returns to the Free plan. For 30 days afterwards, data beyond the Free limits stays available read-only, so you can export it or renew. After those 30 days, the Free plan’s retention and limits apply.

7. Who owns the data, and what role we play

Visitor Data collected from your Sites belongs to you. You are its controller; we are your processor and handle it only to provide the Service, as set out in the privacy policy. We can provide a data processing agreement on request.

Telling Visitors about your use of analytics, and obtaining any consent your jurisdiction requires, is up to you. PathClue’s default mode is designed to work without a cookie banner; whether that is enough for your Site depends on the other tools running on it and the modes you switch on.

We may use aggregated, de-identified usage statistics to run and improve the Service. We do not sell Visitor Data and do not use it for advertising.

8. Intellectual property

The Service — its software, documentation and design — and the PathClue name and logo belong to us or our licensors. While your Account is in good standing you have a limited, non-exclusive, non-transferable right to use them as part of the Service. Unless the law expressly allows it, you may not copy or modify the Service or reverse-engineer it.

All rights in your Sites and data stay with you; you give us only the permission needed to store, process and display them as part of the Service. If you send us feedback or suggestions, we may use them to improve the Service without owing you anything for it.

9. Third-party services and AI features

The Service connects to third parties you choose — payment providers; ad platforms, whose click IDs we read and to which you can send conversions; notification channels; and search platforms’ webmaster tools. Those services have their own terms, and we aren’t responsible for whether they are available or for changes to their APIs.

AI features — insights, event naming, tracking suggestions and asking questions in plain words — are generated by third-party language models and can be wrong. Check what they tell you before acting on it.

10. Disclaimer and limit of liability

The Service is provided as it is and as it is available. We don’t guarantee that it will never be interrupted or contain errors, or that its figures are complete and exact: counts are affected by browsers, ad blockers, network conditions and the rules we use to tell people from bots. Unless we have agreed a service level in writing, we make no commitment on availability.

As far as the law allows, our combined liability for all claims in any twelve-month period is limited to what you paid us in the twelve months before the event that led to the claim. We aren’t liable for indirect or consequential loss, including lost profits, lost revenue from relying on analytics figures, or data you could have exported and didn’t. These terms don’t exclude any liability that the law says can’t be excluded.

11. Suspension and ending the agreement

You can delete your Account in the console at any time, which cancels all subscriptions. Periods you have already paid for aren’t refunded, apart from the refund case in section 4.

We may suspend or close an Account that breaks these terms, hasn’t paid, or poses a security or legal risk; where practical, we tell you first. We may also end the Service for you without giving a reason by giving 30 days’ notice, in which case we refund any prepaid time you haven’t used. After an Account is closed, its data is kept for 30 days for you to export and then deleted.

12. Changes to these terms and to the Service

We may add, change or remove features. Before removing a feature a paid plan relies on, or significantly reducing a plan’s limits, we give at least 30 days’ notice. For significant changes to these terms, we notify you by email or in the console at least 14 days ahead and update the date at the top of this page. Continuing to use the Service after the change takes effect means you accept the updated terms.

13. Applicable law and disputes

These terms are governed by the law of the place where the operating entity is established, excluding its conflict-of-law rules. If mandatory consumer protection law gives you the right to bring a claim where you live, you keep that right. Before going to court, please write to us first — most disagreements are settled in a few emails. If part of these terms can’t be enforced, the rest still applies.

14. Contact us

Questions about these terms: hello@tapcub.com. How we handle data is explained in the privacy policy.
